conducted Sometimes exports are banned At other timesimports are permitted Oftenforward trading in the product is banned Either drought or excess rain is said to be the source of inflation Rising incomes leading to higher demandand supply bottlenecks in an unreformed agricultureare seen to be ultimately responsible The debate over agri-reform to fix supply bottlenecks has been about improvements in cold storage chains; changes in the mandi system; reform of the agricultural marketing system; research support for high value crops; liberalisation of trade in agricultural products; opening up the sector to organised retailing and FDI; moving away from price support for cereals; and so forth Over the last five or six yearsas problems in food prices have surfaced again and againwe have discussed the solutions endlessly Howeververy little has moved on the reform agenda And when prices increase sharplyinstead of a commitment to reformwe hear statements by the government on how it plans to clamp down on speculatorsor stop hoardingor ban derivatives trading The present food inflation could become another episode where the government takes a few visible and meaningless steps to show that it is solving the problemand then essentially heaves a sigh of relief when prices come down Instead it should move forward on the reform agenda To the extent that the reform agenda is politically difficultit will be tough Alsosince there are few short-term gainsas many of the changes would take a few years to yield resultsthe government has to resist the temptation to put its focus on fire-fightingand should steadfastly implement a long-term agenda of reform Political support for the reform agenda is likely to be limitedas opposition parties tend to focus on undermining the government to make political capital But without reform the problem of food inflation will surface again Curbing speculation is not a viable alternative to reforming the sector The second element of government policy to address the inflation issue must be a focus on stabilising macroeconomic policy Fiscal expansionit appearsmight have overshot the needs of the economy The fiscal deficit of the Central government increased sharply between 2007-08 and 2008-09from 31 per cent to 75 per cent of GDP This was due to increased expenditure such as the Sixth Pay Commissionhigher subsidiesand lower taxes during the global financial crisis Howeverthe stimulus continued in the following yearand it remained at 68 per cent of GDP in 2009-10 In the current yearthe fiscal deficit of the Central government is projected to be at 66 per cent of GDP The total deficit of the Centre and the states combined also rose sharply during the crisis Before the crisis it stood at 44 per cent of GDP in 2007-08 and in the current year it is projected to be 96 per cent of GDP The fine-tuning of the stimulus to the needs of the economy is not an easy job Howeverstabilising macroeconomic policy requires that the government should undertake fiscal consolidation This would pull down aggregate demand and curb some of the demand-side push to food prices Another element of stabilising macroeconomic policy needs to be contractionary monetary policy Here the question is: should monetary policy respond to rising food inflation Interest rates are normally seen as an instrument that will hurt investmentbut have no effect on food supplywhich is where the problems are supposed to lie This argument is used to say that monetary policy need not respond to food inflation The issue to examine is whether food price inflation feeds into the general level of inflation If spending on food is a large share of the consumption expenditure basketas it is in Indiafor real wages to stay constantnominal wages must rise significantly Higher nominal wages can result either in lower profits or higher selling prices In serviceswhich are often more labour-intensive especially in the informal sectorwhich constitutes the bulk of the Indian economy it is often easy to perceive But it is exactly here that data is hard to come by Anecdotal evidence does suggest that higher food prices result in the workers in the informal sector getting paid higher nominal wages The relationship between food prices and interest rates is not straightforward The simplistic logic that tries to draw a direct link between interest rates and food prices misses out the role of food prices on inflationary expectations and in wage negotiations Even though wage bargaining in India is not like in Latin Americawhere indexation played a major role in causing inflationin India too the dearness allowance of public sector workersor trade-union negotiations on the basis of which wages are fixedrefer to inflation in consumer prices Indeedeven the NREGA wage is now being indexed to inflation to prevent NREGA real wages from falling Rising food prices and wages feed into expectations of higher inflation The role of monetary policy is to indicate that it will raise rates to curb the growth in aggregate demand so that the shock to food prices does not translate into a wage-price spiral No one step will be able to bring inflation under control The government must adopt a multi-pronged strategy to inflation Agricultural reform must go hand in hand with contractionary fiscal and monetary policy The writer is a professor at the only a very marginal say There is no other process by which there is any kind of participation in the process of appointment of judges Sirboth the pre-1993 system and the post-1993 system had several handicaps The best in this country are not willing to become judges We have to seriously consider why At timesthe selection processwhere only judges appoint judges and the process is a non-transparent processwill always create situations where rumours in the corridors of the court and among those who are close observers of the judicial process will be far too many… We should seriously consider a system which is being debatedabout setting up a national judicial commission The national judicial commission must have judges It must have the participation of the executive It can also have participation of the people selected by a collegium of some eminent citizens It cant only remain the domain of the judges …The criteria for appointment today does not exist Is it today the discretion of the collegium Collegium is also a system of sharing the spoils When the high courts recommendmembers of the collegium share the spoils This is an impression which close observers have Thereforediscretion whether the collegium system continues or we have a National Judicial Commission must also be now statutorily regulatedso that arbitrariness can be avoided After allthere have to be some objective criteria Except elected officesthere is no other appointment which is made where there is no threshold criteria for entry… Thereforewe needI am glad the prime minister himself is herea system where this should be seriously reviewed Secondlysirthe matter of judges judging judges and nobody else participating in this is also an issue which requires a serious review and which requires to be referred toin my opinionthe same national judicial commission The third issue is this When appointments are made we have to seriously consider how the institution functionswhether it functions without any pressures Todaywhether it is politicised appointmentsor it is appointments which lack credibilityor it is a subsequent lack of accountability or biases on account of relativesreligioncasteor personal relationshipsthese are all areas where accountability and vigilance norms have to be improved and increasedso that the independence of the institution can seriously be preserved SirI have always believed that we must seriously consider this larger issue of almost every retiring judgebarring a few honourable exceptionsholding a belief that he is entitled to a job after retirement Jobs have been provided in certain statutes; they are created by certain judicial orders Thereforea search for a job on the eve of retirement beginsas a result of which there is a serious doubt which is raised that retirement-eve judgements at times get influenced by the desire to get a job after retirement ThereforeI thinkwhen there is a bill pending with regard to increasing the retirement age from 62 to 65 in the case of high court judgeswe should correspondingly think of… putting a stop to this practice of everybody being entitled to a job after retirement The desire of a job after retirement is now becoming a serious threat to judicial independence …Separation of powers requires that every institution works in its own spheres And if every institution works in its own spheresit has to lay down the lakshman rekha of its own jurisdiction But why is it necessary to lay down the lakshman rekha of its own jurisdiction What happens if one steps into the others domain And I must candidly confess that this attempt to encroach upon the lakshman rekha is neither coming from governments of the day in the Centre or the statesnor is it coming from the executive or the legislature Some serious sidestepping is coming from the judicial institution itself Thereforewe require a certain element of judicial statesmanship; we require a certain legislative vision so that we can maintain this separation of powers Otherwisewhat should be the economic philosophy of India What should be our economic policy Whether we go to the post-91 policy of liberalisationor we go to state controls is a matter entirely for the executive Courts cannot say that it is neo-liberalism which is creating problems Courts cannot have an ideology The only ideology that courts can have is commitment to the rule of lawand what law is made by Parliament …How Maoism is to be fought or insurgency in the Northeast is to be fought we have gone through these debates in this House That is the domain of the government The government has to decide the policy Courts cannot decide that policy What should be the land acquisition policy The government is seriously contemplating a new Land Acquisition Act What should be the quantum of relief and rehabilitation Nowthese are all examples from the recent past that I am mentioningwhere the space or line of separation of powers itself gets
